THRYFORM
Version 2026-10-12

Trainer Agreement

This agreement applies when you use Thryform as a trainer or coach. It sits alongside the Client Terms of Use, which tell your clients how the Platform works. Please read sections 5 to 9 carefully.

1. About this agreement

1.1 This Trainer Agreement (Agreement) is between you and Thryform (business registration in progress) (Thryform, we, us). It applies whenever you use the Thryform website or app (the Platform) to offer or provide coaching.

1.2 By creating a trainer account, ticking "I agree", or using the Platform as a trainer, you accept this Agreement, our Privacy Notice and any rules shown in the Platform.

1.3 Words defined in the Client Terms of Use (such as Client, Package, Coaching Services, Payment Provider and Service Fee) have the same meaning here. "You" means you as a Trainer.

2. Your relationship with Thryform

2.1 You are an independent business. You are not an employee, agent, partner or franchisee of Thryform, and you can't make promises or sign agreements on Thryform's behalf.

2.2 Thryform provides a marketplace and software. You decide what you offer, your prices, your schedule and how you coach, as long as you follow this Agreement and the law.

2.3 You are responsible for your own taxes, business registration, licences, permits, gym or venue access, and any insurance your work needs. We strongly recommend professional liability (indemnity) insurance.

2.4 Each Package you sell creates a Coaching Agreement between you and the client. You are responsible for delivering it.

3. Eligibility and verification

3.1 You must be at least 18 and legally allowed to provide coaching services in the country where you coach.

3.2 You must upload a valid IC or passport, and only true, current certificates. Don't claim qualifications, experience or results you don't have.

3.3 Thryform may check your documents, ask for more information, and approve, reject or remove your listing at its discretion. A verified badge confirms identity only. It is not Thryform's endorsement of your skills.

3.4 Tell us straight away if anything about your identity, qualifications or right to work changes.

4. Subscription

4.1 You pay a monthly subscription for your plan, as shown on the Subscription page. Free trials end on the date shown.

4.2 Until subscription billing is switched on in the Platform, you won't be charged. We'll tell you at least 14 days before billing starts.

4.3 If a subscription payment fails, we may limit your account until it is paid. Subscription fees are not refundable for part months unless the law requires it.

4.4 We may change plan prices or features with at least 30 days' notice. You can change plan or cancel before the change takes effect.

5. Client payments and the Service Fee

5.1 All client payments go through the Platform. Once in-app payments are available, every payment from a client you found or connected with through Thryform, including renewals and top-ups, must be taken through the Platform. Don't ask for or accept cash, bank transfer, DuitNow or any other payment outside the Platform for those clients.

5.2 No going around the Platform. For 12 months after a client first contacts you or joins you through Thryform, don't move them to payments or bookings outside the Platform to avoid the Service Fee. If you do, we may charge you the Service Fee that would have been due, suspend your account, and remove your rankings and awards.

5.3 Before in-app payments launch, you may take payments directly. Record every Package you sell accurately in the Platform (price, amount paid, dates). You alone are responsible for that money and for any refund you owe.

5.4 Service Fee. Thryform keeps a Service Fee of 3% of each payment taken through the Platform. It is deducted before the Payment Provider pays you. The Payment Provider's processing fee is also deducted, unless you choose to pass it on to the client (Subscription → Client payments). We may change the Service Fee with at least 30 days' notice.

5.5 Payouts. The Payment Provider pays you directly to the bank account you register with them, on their schedule and terms. You must complete their identity checks. Thryform does not hold your money and is not responsible for the Payment Provider's delays or decisions.

5.6 Refunds and chargebacks. You must honour refunds you agree to or owe. If a client's payment is reversed through a chargeback or dispute, the amount (and any related fee) is recovered from you. Where the Payment Provider allows it, we may deduct it from future payouts.

6. Delivering your services

6.1 Deliver the Coaching Services you sell, as described, on time and with reasonable skill and care.

6.2 Give each Package clear terms in the Platform: what's included, how long it lasts, and your cancellation, rescheduling and refund policy. Clients must be able to read these before they pay.

6.3 If you stop coaching a client before their Package is used up, for any reason (you end coaching, close your account, stop working, or are suspended or removed), you must refund the unused part within 14 days: unused sessions at the per-session price, and unused time on monthly or online plans pro rata. This doesn't apply where the client broke your written Package terms.

6.4 Reply to clients within a reasonable time, normally 48 hours, and tell them in advance if you'll be unavailable.

6.5 Keep records in the Platform true. Don't log sessions, workouts, hours or check-in replies that didn't happen. Rankings, awards and your public coaching hours depend on these records.

7. Client safety and professional conduct

7.1 Ask every new client to complete a health screening (the Platform provides one) before their first session. Don't train a client who shows a health warning sign until they have medical clearance.

7.2 Stay within your qualifications. Don't diagnose or treat medical conditions, or give medical, dietetic or physiotherapy advice you aren't qualified to give. Refer clients to a qualified professional when needed.

7.3 Coach in safe places with safe equipment. Make sure clients understand the risks of the exercises you set.

7.4 Keep professional boundaries. Harassment, sexual comments or contact, intimidation, discrimination or pressure of any kind will lead to immediate removal from Thryform. We may also report it to the authorities.

7.5 If you coach anyone under 18, a parent or guardian must have created their account and agreed to the coaching. Follow all child-protection laws.

8. Client data and confidentiality

8.1 You can see personal data about your clients, including health-related information. Use it only to coach that client, and only as the client expects.

8.2 Keep it confidential, during and after coaching. Don't copy it out of the Platform, share it, sell it, or use it for marketing without the client's clear consent.

8.3 Follow the Personal Data Protection Act 2010 (and, for Singapore clients, the Personal Data Protection Act 2012). Tell us straight away if you think client data has been lost or misused.

8.4 Get written consent before you take or share any photo or video of a client, including for your own marketing.

9. Reviews, rankings and reports

9.1 Don't write reviews of yourself, ask friends to, offer rewards for reviews, or pressure or punish a client over a review. Reply to criticism professionally.

9.2 Thryform calculates rankings and awards from activity in the Platform, using rules we may change. They are at Thryform's discretion, and you have no right to a particular ranking or award. We may remove awards won by breaking this Agreement.

9.3 Reports. Clients can report you to Thryform. If we ask, you must reply and give relevant records (such as messages, receipts and session logs) within 7 days.

9.4 While we look into a report, or if we reasonably believe you broke this Agreement or the law, we may: show a warning on your profile, hide you from the marketplace, pause your account, remove reviews or awards, or close your account.

9.5 You agree that Thryform may keep your identity documents and account details as our Privacy Notice explains, and share them with the police, a court, a regulator or other authority when the law requires or allows it, for example in a fraud or safety investigation.

10. Your content

10.1 You own the programmes, videos, photos, recipes and other content you upload. You confirm you have the right to use everything you upload, including any music, images or other people shown.

10.2 You give Thryform a free, worldwide, non-exclusive licence to host, show, copy, resize and translate your content and public profile to run and promote the Platform, while your account is open and for a reasonable time after (for example, in backups or marketing already published).

10.3 We may remove content that breaks this Agreement or the law.

11. Liability and indemnity

11.1 You are responsible for your Coaching Services. You agree to cover Thryform's losses, damages and reasonable legal costs from any claim relating to: your Coaching Services or advice; any injury, illness or loss a client suffers in your coaching; refunds or money you owe a client; your taxes; your content; or your breach of this Agreement or the law.

11.2 To the fullest extent the law allows, Thryform is not liable to you for loss of income, clients, profit, data or goodwill, or for any indirect or consequential loss, including from the Platform being unavailable or changes to rankings, listings or features.

11.3 Thryform's total liability to you for all claims is limited to the subscription fees you paid Thryform in the 6 months before the claim.

11.4 Nothing in this Agreement limits liability that the law does not allow to be limited.

12. Ending this Agreement

12.1 You can close your trainer account at any time by emailing us. Before you do, finish or refund every active client Package (section 6.3).

12.2 We may suspend or close your account, with or without notice, if you break this Agreement, if we receive serious or repeated reports, if your subscription is unpaid, or if the law requires it.

12.3 Sections 5.6, 6.3, 8, 9.5, 11 and 13 continue after this Agreement ends.

13. General terms

13.1 Changes. We may update this Agreement. We'll tell you in the Platform or by email at least 14 days before important changes take effect. If you keep using the Platform after that, the new version applies.

13.2 Transfer. You can't transfer your account or this Agreement. Thryform may transfer it to a company that takes over the Platform.

13.3 Whole agreement and severability. This Agreement, the Client Terms of Use, the Privacy Notice and rules shown in the Platform are the whole agreement between you and Thryform. If any part is found invalid, the rest stays in force.

13.4 Language. This Agreement is available in English and Bahasa Malaysia. If the two differ, the English version applies.

13.5 Law and disputes. This Agreement is governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction. Before going to court, contact us so we can try to resolve the issue within 30 days.
